This paper examines a patient with borderline mental capacity, where the healthcare team is conflicted about how to proceed. This case demonstrates the complicated intersection between undue influence and mental capacity, allowing us to explore how the law is applied in clinical practice. Patients have the right to decline or accept medical treatments offered to them. In Singapore, family members perceive a right to be involved in the decision-making process for sick and elderly patients. Elderly patients, dependent on mainly family (...) members for care and support, sometimes submit to their overbearing influence resulting in decisions that fail to protect the patients’ own best interests. However, the clinicians’ own well-intentioned influence, driven by a desire for the best medical outcome can also be undue, and neither influence should seek to be a substitution for the patient’s decision. Following Re BKR [2015] SGCA 26, we are now obliged to examine how mental capacity can be affected by undue influence. A lack of capacity can be found when a patient fails to appreciate the presence of undue influence or is susceptible to undue influence due to their mental impairment causing their will to be overborne. This then paves the way for the health care team to decide based on best interests, because the patient is determined to be lacking in mental capacity. (shrink)

Hospitalized patients lacking the mental capacity to consent to treatment may demand to be discharged from the hospital against medical advice. Forced custody of these patients, including the use of restraints, may be required if the plan is to proceed with treatment. This raises ethical concerns with regard to depriving people of their liberty. The determination of the wishes and values of the patient and her best interests may sometimes vary, depending on the assessor or the clinical team entrusted to (...) perform the evaluation. We therefore propose the following triad for clinicians when determining the best interests for this group of patients to ensure ethical and legal soundness as well as in providing consistency in approach. Firstly, the treatment should serve as a rescue response. Secondly, any restraint deployed must be proportionate with a foreseeable end. Her liberty and autonomy interests should be enhanced by the treatment. Thirdly, the patient’s family must be supportive. This paper analyzes the use of the triad approach on two clinical cases, both assessed as lacking in mental capacity to decide on treatment and insisting to be discharged. Using this approach, we could justify how the contrasting outcomes, one in which the voluntary discharge was acquiesced versus the other, which was not acquiesced, were reached. We also examine the compatibility of the triad approach with the obligations under the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD). (shrink)

PurposeThis study aims to describe the adverse events following immunization of SARS-CoV-2 vaccination in cancer patients/survivors associated with their psychological distress.MethodsA cross-sectional study was conducted to assess AEFIs after the receipt of SARS-CoV-2 vaccines in cancer patients/survivors attending a university hospital in Malaysia. Psychological distress was measured using the Hospital Anxiety and Depression Scale before and after the first and second doses of COVID-19 vaccine.ResultsA total of 217 complete responses were received. Compared with before vaccination, both HADS Anxiety and HADS (...) Depression scores were significantly reduced after the first and second dose of the SARS-CoV-2 vaccine. Most of the participants had mild-or-moderate systemic and local AEFIs, with the most common being pain at the injection site, tiredness, and headache for both the first and second doses of the vaccine. Positive correlations between the total AEFI score and HADS-A and HADS-D scores were observed after the first dose of the SARS-CoV-2 vaccine. Similarly, positive associations were observed between the total AEFI score and HADS-A and HADS-D scores after the second dose of the SARS-CoV-2 vaccine.ConclusionMild-to-moderate AEFIs found in this study help address vaccine hesitancy in cancer patients/survivors. Receiving the SARS-CoV-2 vaccine had a positive effect on decreasing psychological distress in cancer patients/survivors. High severity of an AEFI was associated with higher anxiety and depressive symptoms. (shrink)

“A Phenomenology of Seeing and Affect in a Polarized Climate,” focuses on the polarized political climate that reflects racial and class differences in the wake of the Trump election. She explores how to see differently about those with whom one disagrees—that is in this specific scenario for Lee, the Trump supporters, including Asian American members of her own family. Understanding Maurice Merleau-Ponty’s exploration of the interstice between the visible and the invisible, if human beings are to see otherwise, we need (...) to disrupt the ready association between the visible and the invisible. Here, she explores the function of affect for the possibility of this break. The phenomenological understanding of emotion does not necessarily empower emotion with any sort of superlative force, especially over reason. But a subject’s emotion chiasmatically reflects the world and vice versa. The caustic and strong emotions felt by people about this presidency reflects the entrenched political climate in our society and chiasmatically the entrenched political climate embroils people in strong emotions that make it difficult to see those with whom we disagree as people we can trust and consider reasonable. To break out of this standoff, to see differently about Trump supporters, one needs to feel differently about them as well. (shrink)

What does it mean to be black in America, to exist as a dark physical body, a "colored" voice, a stigmatized being in a society that sees, hears, and acts according to a set of bleaching assumptions? Versions of that question have echoed across our historical landscape ever since James-town, but rarely have they figured so forcibly as in the 1890s, when the Supreme Court upheld Ferguson over Plessy, Jim Crow laws spread through the South, degenerationists elaborated the "problem of (...) the Negro," imperialists hoisted the "white man's burden" of "little brown brothers" abroad, and racial lynching peaked at an all-time high that incited a national scandal. Any radical hopes for Reconstruction after the Civil War had long since vanished by the years of the fin de siècle. And a century later, the gains of a "Second Reconstruction" movement for civil rights have likewise eroded, with unparalleled "hypersegregation" accentuating new patterns of black poverty, unemployment, family disintegration, homelessness, and addiction.1 Being black, in other words, has meant—and, to a considerable degree, continues to mean—being excluded from white society, white prerogatives, even white discourse itself, in a process whose effects insidiously appear to legitimate the very causes that produce them. 1. C. Vann Woodward first warned of this unsettling repetition of nineteenth-century patterns in his 1965 suggestion that the civil rights movement might constitute a "Second Reconstruction" . In his recent reassessment of the troubling implications of that prediction, he notes how ghetto speech is growing more distinct from standard English: "The result is a vicious circle in which the longer blacks are made victims of the white stereotypes that foster hypersegregation, the more they appear to conform to the stereotypes that were used to justify segregation in the first place, and the deeper victims sink in isolation" . I have taken such pains to indicate the scope, terms, and foci of Neumann's analysis because he provides one of the main pillars on which any further systematic study of the woman hero must rest. By showing Psyche's relation to the mythic or archetypal structure of heroism, by demonstrating the particular ways in which the hero is a figure distinguished primarily by involvement in particular patterns of action and psychological development, Neumann provides an invaluable service to further studies of literature, (...) heroism, and women. Without belaboring the distinction between the hero and the heroine, Neumann validates the claim that a woman can be a hero and eliminates the awkward distinction between the heroine as heroic figure and the heroine as conventional woman that has perplexed so much recent literary, especially feminist, analysis.1 He is also very good at locating the details in Psyche's dilemma that constitute significant associative images within a narrative representing heroism by means of a female character. Specifically, he indicates how Psyche's beauty is as much a burden as a boon, shows the importance of her relationship to other female characters, and points out the ways in which the apparent hostility of other women acts as a necessary goad to Psyche's own developing independence. Neumann's analysis is also suggestive in showing the appropriateness of archetypal criticism to material which is not myth in the narrow sense. To be sure, Apuleius' Amor and Psyche results from the distillation of narratives whose origins are clearly to be found in the folklore and functioning mythologies of Greek and Roman culture; just as clearly, however, Apuleius is telling his tale as part of a highly self-conscious, complexly structured narrative2 analogous, in some ways, to Chaucer's Canterbury Tales, Bunyan's Pilgrim's Progress, Milton's great religious epics, and even that seemingly least mythic set of narrative structures, the novel. · 1. W. H. Auden, the sometimes Greta Garbo of twentieth-century poetry, once told Stephen Spender that he liked America better than England because in America one could be alone. Further, in his introduction to The Criterion Book of Modern American Verse Auden remarked that while in England poets are considered members of a “clerkly caste,” in America they are an “aristocracy of one.” Certainly it does seem to be the individual poet—Whitman, Williams, Olson, Plath, O’Hara, Ginsberg—who has altered the landscape of (...) American poetry and prosody, not the group. And most American literary “movements,” as Robert Creeley has pointed out, are simply comprised of a few people who on occasion drink together, and who are as likely as not to end the evening in violent argument over an aesthetic or political point. Yet the notion of schools or movements remains, in mainstream historical criticism at least, a vital one. How many introductions to anthologies of American poetry, for example, continue to use such rubrics as the Transcendentals, the Populists, the Black Mountain poets, the Beats, the New York group? And while established poets often rebel from any sense that they are part of a larger community, which by definition is self-limiting, they are often complicit in their initial categorization. For poets as well as critics the idea of a school is often a useful fiction serving as both a kind of protective hothouse and a platform for getting a hearing.The most recent “group” of American poets—the first since the anthology wars of the early sixties really to be of more than passing interest and perhaps to be actually capable of bringing about a major shift of attention in American poetry and poetics—is the so-called “Language” school. Individual volumes by poets often considered part of this group number well into three figures now and there have been important journals and anthologies produced in a serious and sustained fashion by these writers. Yet in part because of what seems the essentially hermetic character of the project , there has been little notice of this activity by academic critics or reviewers.1 What I’d like to do here is briefly map a few major aspects of the territory, describing some of the practical and theoretical questions which seem to occupy many of these writers in their ongoing critique of the “workshop poem.” 1. Two important exceptions are discussions of some of this work in Stephen Fredman, Poet’s Prose: The Crisis in American Verse and Marjorie Perloff’s review “The Word as Such: L=A=N=G=U=A=G=E Poetry in the Eighties,” American Poetry Review 13 : 15-22. Conscious experiences are characterized by mental qualities, such as those involved in seeing red, feeling pain, or smelling cinnamon. The standard framework for modeling mental qualities represents them via points in geometrical spaces, where distances between points inversely correspond to degrees of phenomenal similarity. This paper argues that the standard framework is structurally inadequate and develops a new framework that is more powerful and flexible. The core problem for the standard framework is that it cannot capture precision structure: for example, (...) consider the phenomenal contrast between seeing an object as crimson in foveal vision versus merely as red in peripheral vision. The solution I favor is to model mental qualities using regions, rather than points. I explain how this seemingly simple formal innovation not only provides a natural way of modeling precision, but also yields a variety of further theoretical fruits: it enables us to formulate novel hypotheses about the space and structures of mental qualities, formally differentiate two dimensions of phenomenal similarity, generate a quantitative model of the phenomenal sorites, and define a measure of discriminatory grain. A noteworthy consequence is that the structure of the mental qualities of conscious experiences is fundamentally different from the structure of the perceptible qualities of external objects. An episiotomy is ‘an intrapartum procedure that involves an incision to enlarge the vaginal orifice,’1 and is primarily justified as a way to prevent higher degrees of perineal trauma or to facilitate a faster birth in cases of suspected fetal distress. Yet the effectiveness of episiotomies is controversial, and many professional bodies recommend against the routine use of episiotomies. In any case, unconsented episiotomies are alarmingly common, and some care providers in obstetric settings often fail to see consent as necessary (...) in context. In their article, ‘The ethics of consent during labour and birth: episiotomies,’ van der Pijl et al reiterate that consent is necessary for episiotomies. They specify, further, that the antenatal period is crucial for exchanging information, establishing trust between the birthing subject and provider, and exploring the birthing subject’s—rather than the care provider’s—values and preferences regarding episiotomies. They recommend an individualised approach, which would enable birthing subjects to choose how and when they want to give consent. I applaud van der Pijl et al on their practicable recommendations regarding consent for episiotomies. This is certainly a step in the right direction where respect for birthing subjects’ bodily autonomy and integrity is concerned. Still, we must be reminded that consent alone is not coextensive with autonomy. The conditions for securing informed consent in healthcare does not guarantee that one’s decision is truly reflective of their values. Automated facial recognition methods have become widely used as a way to ascertain the identity of individuals. Yet the methods by which facial recognition technologies (FRT) operate – the machinic performance of the perception of the human face – are often invisible to those under their gaze. This article investigates the machinic perception of the face through an FRT method known as eigenface, in order to both reveal and problematize the ways of seeing that underlie it. As part of its (...) algorithmic processes, eigenface produces an image. This image can be understood as a portrait of machine recognition, making visible the processes through which the algorithm performs recognition and ‘sees’ the human face. The eigenface portrait reveals a way of seeing that is based on statistical processes of pattern recognition. An analogue antecedent of this application of statistics to the recognition of facial images can be found in the composite portrait. Through a dialectical discussion of composite portraiture in multiple disciplinary fields ranging from sociology to philosophy and the visual arts, this article experiments with providing a cultural and social translation of machine processes of visual perception. The discussion shifts the focus of enquiry towards the aesthetics of the algorithmic process in order to provide an entry point for critique and a possible reimagination on algorithmic knowledge production. Church's thesis, that all reasonable definitions of “computability” are equivalent, is not usually thought of in terms of computability by acontinuouscomputer, of which the general-purpose analog computer (GPAC) is a prototype. Here we prove, under a hypothesis of determinism, that the analytic outputs of aC∞GPAC are computable by a digital computer.In [POE, Theorems 5, 6, 7, and 8], Pour-El obtained some related results. (The proof there of Theorem 7 depends on her Theorem 2, for which the proof in [POE] is (...) incorrect, but for which a correct proof is given in [LIR]. Also, the proof in [POE] of Theorem 8 depends on the unproved assertion that a solution of an algebraic differential equation must be analytic on an open subset of its domain. However, this assertion was later proved in [BRR].) As in [POE], we reduce the problem to a problem about solutions of certain systems of algebraic differential equations (ADE's). If such a system is nonsingular (i.e. if the “separant” does not vanish along the given solution), then the argument is very easy (see [VSD] for an even simpler situation), so that the essential difficulties arise fromsingularsystems. Our main tools in handling these difficulties are drawn from the excellent (and difficult) paper [DEL] by Denef and Lipshitz. The author especially wants to thank Leonard Lipshitz for his kind help in the preparation of the present paper.We emphasize here that our proof of the simulation result applies only to the GPAC as described below. The GPAC's form a natural subclass of the class of all analog computers, and are based on certain idealized components (“black boxes”), mostly associated with the technology of past decades. One can easily envisage other kinds of black boxes of an input-output character that would lead to different kinds of analog computers. (For example, one could incorporate delays, or spatial integrators in addition to the present temporal integrators, etc.) Whether digital simulation is possible for these “extended” analog computers poses a rich and challenging set of research questions. Speakers often do not state requests directly but employ innuendos such as Would you like to see my etchings? Though such indirectness seems puzzlingly inefficient, it can be explained by a theory of the strategic speaker, who seeks plausible deniability when he or she is uncertain of whether the hearer is cooperative or antagonistic. A paradigm case is bribing a policeman who may be corrupt or honest: A veiled bribe may be accepted by the former and ignored by the latter. (...) Everyday social interactions can have a similar payoff structure (with emotional rather than legal penalties) whenever a request is implicitly forbidden by the relational model holding between speaker and hearer (e.g., bribing an honest maitre d’, where the reciprocity of the bribe clashes with his authority). Even when a hearer’s willingness is known, indirect speech offers higher-order plausible deniability by preempting certainty, gossip, and common knowledge of the request. In supporting experiments, participants judged the intentions and reactions of characters in scenarios that involved fraught requests varying in politeness and directness. (shrink)

Trusting relationships are both valuable and risky. Where the risks are high and the fears of betrayal are also high, it might seem rational to try to mitigate the risks, while still enjoying the benefits of the trusting relationship, by forming a contingency plan. A contingency plan—in the sense I am interested in—involves contingent punishments for defection, which are primarily meant to encourage the trusted partner to act trustworthily. I argue, however, that such contingency plans suffer from an internal tension (...) wherein the contingency planner both seeks and undermines a particular level (or kind) of trust. There are two problems in particular, either of which is sufficient to undermine trusting relationships: one, the planner fails to see the trusted partner as sincerely engaged in the trusting relationship, and two, the planner separates herself out from the trusting relationship by seeing her flourishing as separate from her partner’s (or, even worse, as dependent on her partner’s harm). Continency plans, then, are not just about the future; they cast a moral shadow on what we are doing now. (shrink)

LEE IT HAS BEEN ALMOST ONE HUNDRED YEARS since the publication of Peirce's article "How to Make Our Ideas Clear" in the Popular Science Monthly. There Peirce stated what came to be called The Pragmatic Maxim. 1 Since then pragmatism has been developed and expounded by many proponents. Some of the developments have differed markedly from others, and some of (...) these differences are not easily compatible.2 Opponents of pragmatism have differed in their interpretations in step with the proponents. As the century is rounded out, we should be able to review the scene and appraise the maneuvers and sorties. Just what is pragmatism? It has often been held that pragmatism is not the name of a philosophy but only of a loose collection of philosophies having at most a faint family resemblance. It must be admitted that this interpretation received some support from James's genial and hospitable personality. Nevertheless, I think it is incorrect. We can now discern a central, characterizing position which the early proponents of the new movement were setting forth and defending; and we can free it from misunderstandings that have historically beset it. It was apparent from the first that action and the consequences of action were to be regarded as fundamental to the new position, but this characterization is vague enough to cover many incompatible special developments. It can be sharpened now, after a century of discussion and debate, and we can identify the respects in which action is central, thus separating the general position from the special interests belonging to one or another of the individuals who were its early advocates. Such clarification will reveal a pragmatism that is highly relevant to contemporary philosophy. I. Peirce proposed his maxim as a theory of meaning: the clear apprehension of an idea is to be obtained by considering the effects or consequences on future possible action that follow from the idea. Meanings consist in the possible effects of present experience on future behavior. In accordance with the pragmatic maxim, I shall take the behavioral theory of meaning and the behavioral theory of knowledge that issues from it to be the central position of pragmatism. What is either incompatible or unnecessary to this behavioral core is expendable, and if it has contributed to the misunderstanding or misrepresentation of the core, it should be abandoned in the further development of pragmatism. Interpretations of recollection in the "Phaedo" are divided between ordinary interpretations, on which recollection explains a kind of learning accomplished by all, and sophisticated interpretations, which restrict recollection to philosophers. A sophisticated interpretation is supported by the prominence of philosophical understanding and reflection in the argument. Recollection is supposed to explain the advanced understanding displayed by Socrates and Simmias (74b2-4). Furthermore, it seems to be a necessary condition on recollection that one who recollects also perform a comparison of sensible particulars (...) to Forms (74a5-7). I provide a new ordinary interpretation which explains these features of the argument. First, we must clearly distinguish the philosophical reflection which constitutes the argument for the Theory of Recollection from the ordinary learning which is its subject. The comparison of sensibles to Forms is the reasoning by which we see, as philosophers, that we must recollect. At the same time, we must also appreciate the continuity of ordinary and philosophical learning. Plato wants to explain the capacity for ordinary discourse, but with an eye to its role as the origin of philosophical reflection and learning. In the "Phaedo", recollection has ordinary learning as its immediate explanandum, and philosophical learning as its ultimate explanandum. (shrink)

And Johnson, though never possessing that knowledge, indicates, time and time again, both its utter impossibility and the impossibility of ceasing to utter it—the impossibility that generates time as always already time again, as allegorical temporality, as the compulsion (implicit in the phrase "you (...) should know") to repeat our failure to know it and to call that failure knowledge itself. There's something you should know about Barbara Johnson, and it's something I'm here not to tell you. For telling, as Johnson allows us to see, obscures the unmasterable relation between what's told and the act of telling it. It distracts our attention, in other words, from something else always at work in its words to complicate or confound it, something we've come to identify as the rhetorical, the performative, or the literary, but something to which Johnson, by way of reference to Freud, gives another name as well: "Freud called this something the death instinct, but this death instinct is to be understood as what ceaselessly escapes the mastery of understanding and the binary logic of opposition by exhibiting some 'other' logic one can neither totally comprehend nor exclude." There is an increasing push by journals to ensure that data and products related to published papers are shared as part of a cultural move to promote transparency, reproducibility, and trust in the scientific literature. Yet few journals commit to evaluating their effectiveness in implementing reporting standards aimed at meeting those goals (1, 2). Similarly, though the vast majority of journals endorse peer review as an approach to ensure trust in the literature, few make their peer review data available to (...) evaluate effectiveness toward achieving concrete measures of quality, including consistency and completeness in meeting reporting standards. Remedying these apparent disconnects is critical for closing the gap between guidance recommendations and actual reporting behavior. Would this conference be diagnostic and denunciatory in nature, or would it seek to start something truly new? Certainly we all feel the need of something new—not new, either, in the sense that movements or ideological positions claim to be new, but in the sense of a fresh gathering of common attention in the place where literature is, the place where each of us who loves literature already goes alone. This would be a possibility for something original rather than just another novelty—which makes the question of polemics all the more urgent. An association that founded itself in complaint would be only one more identity-group making a virtue out of its grudge. And the grudge, in that case, would have been a sad reflex of feeling superseded and powerless.But where have the polemics against current orthodoxies been? I am delighted not to have heard them in any strenuous capacity. Even their relative absence hasn’t commanded any extended attention, and that may be an even more telling point. I take this to be partly the result of foresight and good sense. But the clean air here has been more than a reward for our mutual constraint. Instead, it seems evidence of the fact [End Page 193] that, when literature occupies our attention, there is no need for self-defense. Justice, or justification, happens by itself when we “do our own work,” as Socrates recommended.What is our own work, then? This association has made a point, it seems, of declining to prescribe what it should be. The only thing we are absolutely sure of is that its subject is literature, and that its standards and rewards should be of a literary nature. From there the field opens up—and this conference has succeeded in keeping it open in some very concrete ways.Let’s think briefly about the two panels we attended yesterday. The morning panel on “Intellectual Craftsmanship” seemed unified in its concern with the disciplined ways by which we commit ourselves to literary experience. Literature itself, as well as what we do with it, teaches us this discipline, which is “aesthetic” in every sense of that word. Roger Shattuck set the tone when he described the discipline of reading as an issue of preparation and assimilation on the one hand, and as a kind of complete perceptual openness on the other. Such openness, in our normal experience, allows us to be surprised, to see actual things, perhaps, instead of their institutional categories. But literature also requires that we craft our receptivity. The surprises we prepare ourselves to undergo are achieved breakthroughs, which makes them no less unpredictable but all the more deeply affecting.Criticism cultivates such surprising experience. (I think experience is the crucial word, by the way, since everyone on that first panel seemed to be devoted to a kind of free empiricism.) The spectacular moments of visionary power that Robert Alter isolated in Dickens are places that startle and disturb us—and we track our own surprise, and intensify it, when we look closely at how those dark places of power emerge from Dickens’s refiguring of a world where darkness otherwise tends toward an entirely unredeemable opacity. We have to read “synesthetically,” as Shattuck says, “with both eyes open,” to let ourselves be for a moment blinded by such literary places.Once again, the discipline of reading—devotedly and resistantly—frees us for the achieved experience. Hayes began writing these poems (...) straight after Trump's remarkable triumph in the 2016 presidential election, and they race to keep pace with the rapidly metastasizing effects of the Trump phenomenon, from his relentless radicalization of the modes and mores of political speech ("Newshounds ponder the tweets of a bullhorn"), his continuous assault on American democratic institutions, and his singular success in marshalling a newly cohesive political constituency seduced by the reactionary allure of resurgent white nationalism or what Hayes caustically calls "a mandate for whiteness, virility, sovereignty / stupidity" (AS: 38).2 As the phrase "mandate for whiteness" suggests, integral to the story of Trump's ascendancy in American Sonnets is another story, a story about race and social authority in the time of Black Lives Matter when blackness remains "the color of this country's current threat / advisory" (AS: 10). At home and abroad the appalling incandescence of Hayes's contemporary American political moment is reflected by the names of its black victims, names like Trayvon Martin, Michael Brown, Tamir Rice, and, perhaps most explosively of all, George Floyd, whose May 2020 police killing on a Minneapolis street reprised such a familiar configuration of racial power that Hayes had already glimpsed its spectral outline two years earlier: "A [End Page 60] brother has to know how to time travel & doctor / himself when a knee or shoe stalls against his neck" (AS: 77).3Without compromising the intensity of Hayes's focus on this contemporary social emergency, I want in what follows to expand our sense of the historical and metaphysical scene of his writing by reading it as an imaginative response to a larger and more fundamental question: What does it mean to live a black life in an antiblack world? I'm moved to do so by the double register of his writing vividly exemplified by the penultimate sonnet in the sequence which memorializes "All the black people I'm tired of losing / All the dead from parts of Florida, Ferguson / Brooklyn, Charleston, Cleveland, Chicago / Baltimore, where the names alive are / Like the names in graves" (AS: 81). What's remarkable, to my mind at least, about the phrase "the names alive are / like the names in graves" is its fusion of a directly contemporary perception of the precariousness of black existence within a culture of white supremacy (the perception that every black life could share the social fate of Tamir Rice at any particular moment) with an encompassing metaphysical vision of blackness as the embodiment of social death and the continuing afterlife of slavery. Paying close attention to several of Hayes's poems, I will trace this double register to explore a number of ideas central to his thinking in American Sonnets including the foundational role of antiblackness in organizing American reality for both black and white identities, the dialectical relationship between antiblackness and the libidinal economy of white supremacy, and the hope of imagining new possibilities of life capable of contesting the antiblack conditions of contemporary social existence.4 In doing so I will place particular emphasis on Hayes's development of a distinctively dialectical and dialogical style of poetic address that reimagines lyric subjectivity as a drama of racial becoming focused on the relationship between black social death and the culture of white supremacy.5Black Social Death and the Libidinal Economy of WhitenessBefore continuing let me briefly develop three ideas above which help shape my reading of American Sonnets: the social life of social death, the continuing afterlife of slavery, and what Hayes calls in my epigraph "the [End Page 61] invention of blackness." In this paper, we build a new case for ontological pluralism in the form of three contributions: (1) We offer a theoretically useful definition of ‘way of being’ as a positive principle of similarity and difference that is distinct from—and a prior condition for—having properties. (2) We develop a test for distinguishing ways of being from properties: features of entities that are conceptually redundant when represented as predicates in standard (...) predicate logic are ways of being. Finally, (3) we argue that there are ways of being, i.e., there are features of entities that satisfy the definition in (1), and pass the test outlined in (2). In this paper, I am going to ask what the general criteria for identity are and exactly how essence is related to that. Two notions are related to this question: Essential properties (necessary properties) and individual essences. Only the notion of individual essence has been involved in the criteria of transworld identity. The disputes of transworld have centered on the intrinsic properties necessarily connected to thisness. Through introducing a notion of part-rigidity, however, we can see that there can be an (...) entity that does not have an individual essence as an intrinsic property necessarily connected to thisness, the non-part-rigid structure. Being this structure is an intrinsic property that is relational and compositional. An entity that has a relational and compositional intrinsic property as its necessary property seems to have no individual essence. It remains a curious fact, however, that Aquinas varies his opinion as to whether analogy of attribution (...) or analogy of proportionality (sometimes referred to as analogy of proper proportionality as attribution is referred to in the literature as analogy of proportion) is the proper mode of analogical predication. In fact, as we shall see, Aquinas himself imports elements of the analogy of attribution into the analogy of proportionality. What needs to be investigated, then, is what characterizes these two modes of analogy; what makes them both analogy; why do they differ. Before understanding the specific nature of each form of analogy, however, one should understand why Aquinas appealed to analogy in the first place. Finally, one should attempt to grasp what the implications of each form of analogy are for Aquinas's metaphysical system and why he seems to favor the analogy of attribution over that of proportionality at crucial points in his thought. Why analogy? In general, one can say that Aquinas uses the concept of analogy (and that of proportionality) to solve two problems. On the one hand, the concept of analogy is used to argue that God does, 1 In I sent., 19. 5. 2, ad 1. 471 472 RICHARD LEE in fact, have knowledge of his creatures. The issue here is that the intellect knows in proportion to the thing known. However, God is infinite and if he knows anything finite he would know that thing in proportion to the created, finite thing. Since there is no proportion between finite and infinite, God cannot have any knowledge of his creatures.2 The element of knowledge, however, is not merely a preface to the discussion of the types of analogy. Aquinas argues that we can name a thing insofar as it is known.3 Since we have no concept of God (in his essence), we cannot name God, at least in the same way we name other things. On the other hand, Aquinas uses analogy to fill a metaphysical gap in his system. For he agrees with Pseudo-Dionysius and Maimonides that we cannot know God in his essence. Therefore, any names that we apply to God are not names which tell us anything about God. Aquinas is well aware that the God of revelation is not a God about whom one ought to speak. To say anything at all about God is already to say too much; it is already doomed to failure because of God one should not speak. However, this situation leaves Aquinas in a peculiar position. For he takes seriously the Aristotelian dictum that a thing is known only when its principles are known.4 If God is the principle, something must be known of him if anything is to be known at all. There must be some way to speak of God. Aquinas sees in analogy a middle ground between these two positions. For what he seeks is a mode of predication that lies between univocity and equivocity. In other words, he seeks a mode of predication that predicates the same thing in a different way of two (or more) things. I suggest in my opening section that this reading is derived from Leibniz's misconception of Spinoza's method, and go on to develop a spinozistic account of aesthetic experience which is relational, but which sees it as rooted in human sensibility (imagination). In the closing section I take up the issue of intersubjective valuation, and the question how aesthetic values are shared within the human community. I suggest (...) also that Spinoza's somewhat out-of-fashion approach to aesthetic valuation through the concepts of 'beauty' and 'well-being' are worthy of further attention and development by contemporary aestheticians. This essay defends the asymmetry between the badness of spontaneous and induced abortions in order to explain why anti-abortionists prioritize stopping induced abortions over preventing spontaneous abortions. Specifically, it argues (1) the distinction between killing and letting-die is of more limited use in explaining the asymmetry than has sometimes been presumed, and (2) that accounting for intentions in moral agency does not render performances morally inert. Instead, anti-abortionists adopt a pluralist, nonreductive account of moral analysis which is situated against a (...) backdrop that sees the limits of our ability to control the process of fertility as themselves valuable. Although this view is complex, the paper concludes by arguing that it has the advantage of explaining features of the anti-abortion outlook that have sometimes been overlooked. First, it accounts for why the pre-Roe regime of abortion restrictions primarily imposed penalties on doctors who induced abortions rather than the women who seek them. Second, it explains why the advent of ectogestation will not prompt anti-abortionists to compromise on ‘disconnect abortions,’ which putatively let the embryo die by extracting it from the mother’s womb. Marx holds that mankind has developed from nature and in mutual interaction with nature: nature is not an “other” but is man’s body. Capitalism is a necessary stage in mankind’s historical development of the mastery of nature, but it regards nature as an “other” to be exploited. Thus, a further historical development is necessary: the overcoming of the dichotomy between man as subject and nature as object.Capitalism bases its concept of wealth on unnecessary production rather than on socially useful production (...) and on the maximization of true leisure and free and creative activity for all. It creates excess pollution and depletes nonrenewable resources as a result of this wasteful, exploitative, unnecessary production. A Marxian solution to environmental problems involves the replacement of capitalism with a rational humane, environmentally unalienated social order. Unfortunately, the actual practice of Marxism has not generally been in accord with its own theory. Such rational, humane social orders have not yet been instituted, but they must be soon. We must take one aspect of Marx’s ideas to its logical conclusion: Marxist practice has been, at best, homocentric, but now it must overcome that limitation and truly see nature as our “body.” Marxism must become ecologically aware; mankind must become the steward of its “body”: the ecosystem upon which it depends and which now depends upon it for its health (homeostasis). Social philosophers often invoke the concept of false consciousness in their analyses, referring to a set of evidence-resistant, ignorant attitudes held by otherwise sound epistemic agents, systematically occurring in virtue of, and motivating them to perpetuate, structural oppression. But there is a worry that appealing to the notion in questions of responsibility for the harm suffered by members of oppressed groups is victim-blaming. Individuals under false consciousness allegedly systematically fail the relevant rationality and epistemic conditions due to structural distortions of (...) reasoning or knowledge practices, undermining their status as responsible moral agents. But attending to the constitutive mechanisms and heterogeneity of false consciousness allows us to see how having it does not eo ipso render someone an inappropriate target of blame. I focus here on the 1889 anti-suffragist manifesto “An Appeal Against Female Suffrage,” arguing that its signatories, despite false consciousness, satisfy both conditions for ordinary blameworthiness. I consider three prominent signatories, observing that the irrationality characterisation is unsustainable beyond group-level diagnoses, and that their capacity to respond appropriately to reasons was not compromised. Following recent work on epistemic injustice, I also argue that culpable mechanisms constituted their false consciousness, rendering them blameworthy for the Appeal. (shrink)

The 2017 story of Charlie Gard is revisited. Upon the British High Court’s ruling in favor of the physicians that the infant should be allowed to die without the experimental treatment, the view of the public as well as the opinions of bioethicists and Catholic bishops are divided, interestingly along with a cultural line. American bioethicists and Catholic bishops tend to believe that the parents should have the final say while British/European bioethicists and Catholic bishops in general side with the (...) court’s decision. The paper explores the place of culture in bioethical reasoning between the UK/Europe and the US while claiming that cultural differences are more important than geopolitical or religious differences to understand the bioethical positions of a group. In addition, the authors introduce a decision-making program for handicapped neonates which is developed by the American Jesuit Bioethicist, Richard McCormick, and modified further by the contemporary American Jesuit Bioethicist, Peter A. Clark, in an attempt to see if the program’s normatizing categories can contribute to the culture-laden ethical discussions on Charlie’s case. However, it is admitted that the McCormick-Clark device is borne out of the American and Catholic theological context. (shrink)

The principle of national self-determination holds that a national community, simply by virtue of being a national community, has a prima facie right to create its own sovereign state. While many support this principle, not as many agree that it should be formally recognized by political institutions. One of the main concerns is that implementing this principle may lead to certain types of inequalities—between nations with and without their own states, members inside and outside the border, and members and nonmembers (...) inside the same nation state. While these inequalities may arise, I shall argue that they are not unjust. These worries are partly the results of confusing two types of interests that a national group may have—in cultural affairs and in political affairs. While a national community should enjoy rights over their cultural affairs, this does not grant them authority over other non-cultural, political affairs. Once the distinction is drawn, we can see that there are constraints on the implementation of this principle. Consequently, these inequalities justify setting limits to a group’s right of self-government, although they do not conclusively refute the right itself. (shrink)

As is well known, dialog partners manage the uncertainty inherent in conversation by continually providing and eliciting feedback, monitoring their own comprehension and the apparent comprehension of their dialog partner, and initiating repairs as needed (see e.g., Cahn & Brennan, 1999; Clark & Brennan, 1991). Given the nature of such monitoring and repair, one might reasonably hypothesize that a good portion of the utterances involved in dialog management employ meta-language. But while there has been a great deal of work on (...) the specific topic of dialog management, and it is widely (if often tacitly) accepted that meta-language is frequently involved, there has been no work specifically investigating and quantifying the role of meta-language in dialog management. The notion of Ivan Illich as a social critic, philosopher, or historian is seen as secondary to the principal thrust and purpose of his life and work. To understand Illich, it is more important to see his journey into apophatic expression. After his period as a churchman in the Catholic Church, he developed a unique series of books and articles characterized above all as apophatic theology. The author explains the meaning of the term and examines the different ways in which (...) Illich used this approach. Illich studied technological artifacts, whether individual devices or institutional structures, in terms of their relationship to Christian belief in the Incarnation. His work is interpreted in terms of its consonance with the thought of Jacques Ellul. National sentiments find expression in multiple political spheres and cause troubles of various kinds in many societies, both domestically and across state borders. Some of these problems are rooted in history; others are the result of massive global immigration. As US Secretary of State John Kerry tries to broker a new round of Israel-Palestine peace talks, the Israeli government continues expanding its settlements in disputed (...) territories. As this proposal is being written, Japanese citizens are debating whether their politicians should visit the Yasukuni Shrine (靖國神社), where the spirits of fourteen Class A war criminals from WWII and more than one thousand others convicted of war crimes by the International Military Tribunal for the Far East are honored with a distinguished resting place. As the Chinese government’s plan to bring economic prosperity to the Xinjian province unfolds, ethnic conflicts between Han Chinese and local Uyghur Muslims intensify. Tibetans still demonstrate to the Chinese government, some through the dramatic sacrifice of self-immolation, their determination to pursue a Tibet that is truly free and autonomous. The recent inflow of Muslim immigrants across Europa and North America forces those liberal democratic societies to rethink the meaning of multiculturalism. Should the state respect Muslim women’s freedom to wear burkas in public? What about other aspects of certain Muslim traditions such as arranged marriages or the honor killing of teenage girls who see boys their parents do not approve? Since these immigrants voluntarily moved from their homeland to a new society, do they have a duty to give up such practices, which conflict with their new societies’ fundamental commitment to individual autonomy? Eric Hobsbawm suggests that nationalism is a contingent phenomenon in history—it arises with important historical events such as industrialization and print journalism; eventually, it will disappear. Anthony Smith, on the other hand, argues that nationalism is deeply rooted in the human need for collective faith and dignity. How should we understand today’s nationalism? Is it a transient phenomenon that eventually will be eradicated from the world, or is it a timeless issue that confronts and will remain a challenge for every society? Is the conventional distinction between civic and cultural nationalism still relevant or helpful? The problems and ongoing challenges of nationalism are very much alive throughout East Asia where the myth of ethnically and culturally homogeneous nations is still paramount. In addition to the examples provided above, East Asian societies are increasingly multicultural, inevitably forcing their governments to come up with new immigration and border-control policies, revisit their laws regarding labor policies, sociopolitical discrimination, socioeconomic welfare, and, more fundamentally, rethink the constitutional make-up of the citizenry and the ideal of social harmony, one of their most cherished political values. Nevertheless, contemporary theoretical analyses, whether philosophical or empirical, of the phenomena surrounding nationalism, in all its forms, are almost exclusively focused on cases in western cultures and societies, preventing the East Asian people from developing a coherent idea of who they are or should be in a way that can track their deeply-held values and norms (such as Confucianism). One of the primary aims of this conference therefore is to address this ongoing neglect and explore new concepts and theories that are socially relevant in East Asia. Not only will this provide access to the particular experiences of nation, citizenship, and nationalism throughout East Asia but it will bring to bear philosophical concepts, approaches, and styles of reasoning about them that currently are not part of this critical debate. Providing an opportunity to hear these distinct and different East Asian voices and opening up these conceptual and methodological resources to scholars around the world will greatly advance the understanding and appreciation of nationalism. In addition to this primary aim, the proposed conference will achieve two other, novel, and important goals. First, by design, it will bring to bear a multi and interdisciplinary approach to the problems of nationalism. We are not privileging either conceptual or empirical studies in the organization of our conference and will bring together philosophers, political scientists, sociologists, and historians, making every effort to invite scholars who explicitly employ or are interested in exploring different and at times hybrid approaches. Second, we will draw together scholars from around the world: China, South Korea, Japan, Taiwan, North America, and Europe, including leading figures in the field, who will serve as keynote speakers for the conference. Combining these two additional goals will enable us to organize a uniquely diverse conference, both in terms of intellectual discipline and national origin. Along with our primary aim of introducing East Asian voices and theories, this will make our event original, distinctive, and unprecedented in value. Our age is one in which it is unavoidable for people of different cultural backgrounds to live together in many different places. The first problem is that the advocates and opponents of common morality, consciously or unconsciously, define the moral terms in question in a way that their respective meanings would naturally lead to the outcomes that each party desires. Facticity itself is interpretive in that it sees what something is through question and answer. Heidegger is stepping back into the factors that precondition our understanding, the "forestructure" of understanding. In this essay, Soyoung Lee explores the theme of mourning as a way of attending to a fundamental aspect of human experience that is bound to negativity. The essay helps readers to see that experience in a different light by drawing on what is shown to be an internal connection between mourning and having language. The dominant culture of contemporary education is preoccupied with management and control, and this renders hollow the understanding of the negative experience children go through. Such (...) experience, if it is acknowledged at all, is regarded as requiring intervention and perhaps correction. Yet negative experience, as Lee tries to show, is the very source of personal growth. This is to take human experience as wounded, and the wound as the very place for the creation of our own words. A hasty approach toward an individual's suffering, whether in the name of “healing” or “knowledge,” becomes a suppression of voice. In its denial of the otherness within the self, it neglects the possibilities of self-transformation. The essay pursues these ideas through a reading of contrasting works of art: some poetry by Paul Celan (in conjunction with Jacques Derrida's response to it) and Still Walking, a film directed by Hirokazu Kore-eda. Both artworks deal with their own wounds and words in ways that are instructive. (shrink)

This article examines Heidegger’s interpretation of Plato’s Sophist, focusing on his attempts to grasp Plato’s original thinking of being and non-being. Some contemporary thinkers and commentators argue that Heidegger’s view of Plato is simply based on his criticism against the traditional metaphysics of Platonism and its language. But a close reading of his lecture on the Sophist reveals that his view of Plato is grounded in Plato’s questioning struggle with the ambiguous nature of human speech or language. For Heidegger, Plato’s (...) way of philosophizing is deeper than the metaphysical understanding of Platonism which sees only fixed ideas of being. In the Sophist, dialectical thinking of Plato constantly confronts the questionable force of the logos which betrays the natural possibility of non-being based on the tension between movement and rest. Thus, from Plato’s original insight Heidegger uncovers the dynamic association of being and non-being as a natural ground of everyday living with others. However, although Heidegger’s understanding of the Sophist powerfully demonstrates the lively possibility of being beyond the customary perspective of Platonic metaphysics, his interpretation fails to further disclose Plato’s political question of being emerging in the Sophist, which seeks the true associative ground of human beings. We achieve several results. First, we develop a variant of the theory of absolute Galois groups in the context of many sorted structures. Second, we provide a method for coding absolute Galois groups of structures, so they can be interpreted in some monster model with an additional predicate. Third, we prove the “Weak Independence Theorem” for pseudo-algebraically closed (PAC) substructures of an ambient structure with no finite cover property (nfcp) and the property [Formula: see text]. Objective: Individually, vision and hearing impairments have been linked to higher levels of anxiety and depression. We investigated the effect of dual sensory impairment in a large representative sample of Spanish adults. Methods: Data from a total of 23,089 adults from the Spanish National Health Survey 2017 were analyzed. Self-reported difficulty of seeing and hearing, and depression and chronic anxiety were analyzed. Multivariable logistic regression was assessed for difficulty with vision alone, hearing alone and with difficulty with both, adjusting for (...) gender, age, marital status, living as a couple, education, smoking, alcohol consumption, BMI, physical activity, use of glasses/contact lenses, and hearing aid. Results: Visual difficulty, hearing difficulty, and dual difficulties were all associated with significantly higher odds for depression and for chronic anxiety. Dual sensory difficulty was associated with higher odds ratios for depression and anxiety when compared to either impairment alone. Conclusion: Dual sensory difficulty is associated with significantly higher odds of anxiety and depression when compared to either vision or hearing difficulty alone. Appropriate interventions are needed to address any reversible causes of vision and hearing as well as anxiety and depression in people in these specific groups. (shrink)
